The Supreme Court of Justice of the Nation has generated confusion and surprise in the Government due to its decision to reject the license request made by federal judge Ariel Lijo. Although the resolution has not yet been formalized, the information was leaked while Ricardo Lorenzetti was preparing to sign in disagreement with the rest of the court members, whose determination carries the signatures of Horacio Rosatti, Carlos Rosenkrantz, and Manuel García-Mansilla.
The bewilderment in the Government is due to the fact that the resolution was not previously communicated and generated unrest among those who had worked to bring Lijo to the Supreme Court. President Javier Milei had progressed in the appointment of the judge through a decree, which further complicated the situation. From Karina Milei's environment, it was argued that this rejection represents a display of judicial independence that the Government promotes, pointing out that there is no automatic majority in this case.
This decision puts judge Ariel Lijo at a crossroads, who now must evaluate whether to resign from his position in federal court 4 of Comodoro Py. Although there is still uncertainty about his future, the Government assures that it will not withdraw its proposal and will continue to insist on his appointment. The possibility of Lijo being approved to join the Court for life depends on obtaining the necessary votes in the Senate, one year after being proposed.
Lijo was the only one of the two judges chosen by the Government who received a favorable opinion in the Senate's agreements commission, with the support of various senators. Despite being on the verge of being addressed in extraordinary sessions, the lack of agreement with Kirchnerism postponed his appointment. The intention to include other issues in the voting package led Deputy Justice Minister Sebastián Amerio to withdraw from the negotiations.
The lack of information and the surprising action of the Supreme Court, especially from Manuel García-Mansilla, have sparked reactions in the Government and in judge Lijo's surroundings. Although the final vote has not yet been carried out, uncertainty reigns regarding the future of the magistrate and the resolution of this unexpected situation.
