
National Senator Florencia López (La Rioja-Popular Front) announced today that Kirchnerism in the Upper House will reject the appointment of any judge appointed by decree and will seek the removal of those who accept that the Executive Branch violates the National Constitution. In her statements to Radio Rivadavia, the senator expressed: "The judge who agrees to be appointed by decree will directly face the deep rejection of the Senate, and we will proceed with their removal."
López explained her position by arguing that if a judge accepts being appointed by decree, it is an indication of how they will act subsequently, implying that they will not guarantee respect for the Constitution. The senator emphasized that the Constitution establishes that judges must be appointed by the Executive's proposal and with the Senate's approval, which means that appointing two judges to the Supreme Court by decree would violate this regulation.
In this sense, she stressed that the system of separation of powers prevents the Executive from appointing a judge only with their signature, as the President cannot act as an "emperor" and must respect the separation of powers. The senator expressed her hope that the Executive seeks a republican agreement among the different sectors, but mentioned the lack of dialogue and willingness to agree on fundamental issues for the Government and the Senate.
