Court Upholds Assistance Programs for Victims of Gender Violence

The A Chamber of the National Appeals Court in Administrative Litigation has rejected the Government's request to enable the judicial holiday to address the appeal of a precautionary measure that protects assistance programs for women and children in cases of gender violence. The ruling, signed by judges Mariano Duffy, Rogelio Vincenti, and Jorge Morán, maintains the prohibition imposed on the Government from eliminating these programs.

The ruling comes after a presentation made by several organizations, including the Latin American Justice and Gender Team, Ni Una Menos, FEIM, Fundeps, and MxM. These organizations requested that any action jeopardizing the assistance programs for women and children victims of gender violence nationwide be stopped.

The pronouncement of Chamber A highlights that if the closure of the Undersecretariat for the Protection Against Gender Violence and the 81 Access to Justice Centers occurred without guaranteeing a minimum level of services, the unconstitutionality of these measures would be declared. The precautionary measure, which prevents the closure, defunding, and dismissal of personnel from these programs, remains in effect after the decision not to enable the judicial holiday.

The National Court of First Instance in Federal Administrative Litigation No. 1 has also partially admitted the precautionary request, ordering the National State and the Ministry of Justice to refrain from reducing human resources and the institutional infrastructure of the Undersecretariat for the Protection Against Gender Violence and the Centers in charge of those agencies.

In summary, the current judicial decision prevents the Government from proceeding with the elimination of assistance programs for women and children in cases of gender violence, having to wait until March for any action regarding this. The precautionary measure remains in effect, and the legal dispute between the State and the organizations defending these programs continues.
