
The National Disability Agency (ANDIS) announced changes in the requirements for obtaining Non-Contributory Pensions (PNC) for Labor Disability, affecting more than 1 million beneficiaries. Resolution 187/2025 formalizes a new classification system to evaluate labor incapacity and ensure equitable allocation of these pensions.
The new regulation establishes a specific classification for each system of psychophysical conditions, determining if they constitute sufficient grounds for labor incapacity to receive the benefit. The conditions will be evaluated in four categories: always favorable, assessable, low incapacity, and without incapacity.
To access the PNC for Labor Disability according to Decree 843/24, one must prove a 66% reduction in labor capacity and meet requirements such as not having formal employment, presenting an ID, residing in Argentina for a certain period, among others.
Additionally, it was discovered that 150 deceased individuals and 212 detainees were still receiving the pension unjustly. The process will consist of four stages: sending letters with appointments, interviews and medical checks, documentation analysis by ANDIS, and issuing rulings that will determine the continuation of the benefit.
The procedure to obtain the PNC for Labor Disability involves the evaluation of medical and socioeconomic documentation, including the revision of the CMO, economic analysis, data verification, and confirmation of requirements. The CMO is necessary to validate the diagnosis and grant the benefit, but non-compliance may lead to its suspension or cancellation.
The Government plans to conduct a comprehensive audit of the PNC for Labor Disability in 2025 to ensure compliance with the requirements, especially those granted during the previous administration. According to official data, only 20% of the pensions reviewed last year met the legal requirements.
