The Municipality of Morón presented a legislative initiative on Wednesday to allow the Buenos Aires province judiciary to detain individuals who violate perimeter restrictions in cases of gender-based or family violence. This is a response to recurring demands from organizations and judicial operators pointing to a 'grey area' in current legislation. According to the Argentine News Agency, the project, spearheaded by Mayor Lucas Ghi, proposes changes to the Buenos Aires province Code of Criminal Procedure. The proposal stipulates that violating a restraining order should immediately enable the presiding judge to intervene, including the issuance of a preventive detention order if there is a verified risk to the victim's integrity. The initiative was presented on the International Day for the Elimination of Violence Against Women during an event that brought together judges, prosecutors, defenders, and specialists in criminal and gender law from the Morón Judicial Department and other districts. According to local Executive officials, the proposal aims to unify criteria in cases where the aggressor, despite an active restraining order, continues to harass, threaten, or even attack the victim, without clear tools to detain them until a more serious incident occurs. The project's design was contributed by the Secretary of Security, Damián Cardoso; the president of the Association of Judges and Officials of Morón, Matías Rappazzo; and specialist Fabián Cardoso from the Federal Observatory of Security and Justice, among other local judicial leaders. 'We are convinced that gender-based violence is combated with concrete measures and articulation between the State and the Judiciary, far from political opportunism,' stated Ghi when presenting the initiative, which will be sent to the provincial legislature in the coming days for its consideration.
