Lawyer Working on Reform Says Waiters Benefit from 12-Hour Shifts Due to Tips

A lawyer involved in Argentina's labor reform made a surprising statement. He claims that the introduction of a 'time bank' will allow workers, like waiters, to earn more by working 12-hour shifts to receive higher tips. This is a key element of the new bill, aimed at creating 'dynamic' salaries and flexibility in labor relations.

Julian De Diego, a lawyer representing business interests, admitted that he is actively collaborating with the National Government in drafting the labor reform bill. This project is expected to be presented in mid-December with the intention of being addressed in extraordinary sessions. 'The draft we are working on with the Secretary of Labor [Julio Cordero] has three axes: dynamic salary, which makes sense in a scenario without inflation and to allow for salary increases based on productivity,' De Diego said. Another axis is to flexibilize collective bargaining, making it company-based rather than industry-based. He also came out in favor of extending the workday and having 'dynamic' salaries based on work done. 'Finally, there is the issue of the time bank, which can be useful depending on the activity,' said the radio specialist De Diego, founder and head of the 'de Diego & Asociados' firm, one of the chosen by the toughest business groups in Argentina. In his radio statements, the lawyer also specified why it could 'benefit' workers under the reform. 'The new employment contract must be fluid, simple, with freedom for the parties,' he pointed out, explaining that 'the workday should be through a time bank, which has existed since 1991 but was only used in selective activities.' 'The time bank will allow the worker to have a flexible remuneration, which will be called dynamic, because they will have the basic collective agreement that will guarantee them the minimum category, but they will be able to earn more than what the agreement states through a productivity mechanism,' he said. In statements to El Destape 1070, he highlighted that 'with the application of the time bank, a person could work up to 12 hours a day.' 'The average workday implies that if a worker works 12 hours one day, they work 6 hours the next,' he pointed out and explained, 'if I are a waiter, it is convenient for me to work 12 hours because I receive more tips.' 'If I are a waiter, it is convenient for me to work 12 hours because I receive more tips,' he explained.
