Federal Court Rejects Nullity Motion in ANDIS Case

The Federal Court of Appeals has decided to reject the motion to declare null and void everything done in the ANDIS case investigation. This decision came after a hearing where the defense for the former head of the agency, Diego Spagnuolo, claimed that, according to his client, the audio recordings where he speaks of bribes paid by pharmacies are fake. Spagnuolo's new lawyer, Mauricio D'Alessandro, told the judges of the Appeals Court's Division II that his client asserts that the recordings in which he is heard detailing bribery payment mechanisms by the pharmacy Suizo Argentina and mentioning Karina Milei are 'fake'. The appellate judges Martín Irurzun, Roberto Boico, and Eduardo Farah heard the defense and Prosecutor Franco Picardi, who ratified the validity of everything done so far in the investigation and were in a position to rule on the nullity motions. D'Alessandro, Spagnuolo's third lawyer in the case, argued that these recordings were edited or 'made with artificial intelligence' and that the former head of the National Disability Agency claims it is not his voice on the recordings. Picardi, for his part, warned that the recordings were a trigger for the case, which is supported by other evidence, while the case remains under seal. The nullity was rejected by the case judge, Sebastián Casanello, and the defense for the owners of Suizo Argentina, the Kovalivker brothers, and Spagnuolo's defense appealed to the Federal Court of Appeals, which must now resolve the issue.
