Severe Sentences for Child Sexual Exploitation in Misiones

The Criminal Court No. 1 issued a ruling in the case of brothers Germán and Sebastián Kiczka, convicting them for possession, facilitation, and distribution of child sexual abuse material in the province of Misiones. Sebastián received a sentence of 12 years in prison, while Germán was sentenced to 14 years in prison.

In Sebastián's case, his conviction was based on his criminal liability for the offenses of possession and facilitation of aggravated child sexual exploitation material, as well as sexual abuse without carnal access, all in real concurrence. The ruling considered as aggravating factors the vulnerability of the victims, the abuse of power, manipulative behaviors, the number of devices with material, and the socioeconomic environment.

Regarding Germán, he was imposed a sentence of 14 years of effective imprisonment for the crimes of possession, facilitation, and distribution of child sexual exploitation material, also aggravated by the fact that the victims were under 13 years old, in real concurrence.

The voting occurred with a majority of votes from the judges of the court, with Judge Cukla dissenting in this regard. In the deliberation, the specific action of distributing material, the severity of the shared content, the organization of the files, the condition of public official, and the distribution of child sexual exploitation material were considered as aggravating factors.

The Public Prosecutor's Office had also requested the investigation of Leonardo Kiczka, father of the accused, and deputy Pedro Puerta. The extraction of copies of the entire process was authorized for submission to the Instruction Prosecutor's Office.

The sentences were read in the presence of all parties on Tuesday by judges Gustavo Bernie, Viviana Cukla, and César Yaya. The grounds were based on the guilt of the Kiczka brothers in the aforementioned crimes, which occurred in the province of Misiones.
