Controversy Over DNU Signed by President Milei

Javier Milei's Decree to advance an agreement with the IMF faces legal challenges due to existing laws requiring Congressional approval, according to legal experts.

Controversy Over DNU Signed by President Milei

A legal expert, Facundo Fernández Pastor, warned that the Decree of Necessity and Urgency (DNU) signed by President Javier Milei to move forward with the agreement with the International Monetary Fund (IMF) presents a contradiction with an existing law, which could lead to legal issues. In a social media post, the lawyer pointed out that the government did not repeal Law 27.612, which stipulates that any pact with the IMF must be approved by Congress.

"If he was going to issue a DNU, he at least had to add an article that repealed Law 27.612 that he intends to violate, since otherwise, there are two norms that contradict each other," Fernández Pastor stated. According to him, this situation raises an "indirect federal question," citing jurisprudence from the renowned jurist Lino Enrique Palacio.

These statements generated repercussions among specialists and opposition leaders, who have been questioning the constitutionality of the decree and demanding that the agreement with the IMF be debated in Congress.
