
A group of national deputies from Unión por la Patria close to Axel Kicillof filed a criminal complaint against President Javier Milei for the imminent signing of a decree of necessity and urgency to agree with the International Monetary Fund, in open violation of a national law and constitutional clauses.
The presentation was supported by constitutional lawyer Eduardo Barcesat and bears the signatures of Juan Marino, Victoria Tolosa Paz, Hugo Yasky, Julio Pereyra, Brenda Vargas Matyi, and Sabrina Selva, who represent the province of Buenos Aires. Except for Selva, who is affiliated with the Renovating Front, the other deputies are close to Kicillof's framework, who recently launched his own current within Peronism: the Movement for the Right to the Future.
In the presented document, it is argued that the attempt by the National Executive Power to approve an agreement with the International Monetary Fund through a Decree of Necessity and Urgency violates constitutional clauses and Law 27,612 on Strengthening the Sustainability of Public Debt of 2022. It was mentioned that these facts could be considered as abuse of authority, violation of public official duties, and related to provisions of the Argentine Penal Code.
The deputies request that the Court suspend any act that may constitute the consumation of this criminal act. It is emphasized that, once the decree is published and sent to Congress, it must be addressed in the Bicameral Commission of Parliamentary Procedure within ten working days to rule on its validity or invalidity.
For the Decree of Necessity and Urgency to be annulled, it requires the rejection of both legislative chambers. If at least one of them approves it, the decree will remain in force. The maneuver of the Argentine government has generated uncertainty regarding its legitimacy, although strategically it places the burden on the opposition to gather votes to cancel it in both parliamentary bodies.
