
The appointment of Pablo Biró as a member of the board of Aerolíneas Argentinas has generated controversy within the company. According to internal sources, there is no formal act of appointment that meets the requirements of the General Companies Law, so this appointment is not considered valid for the company.
Additionally, it has been pointed out that the company will do everything possible to prevent Biró, whom they accuse of acting against the interests of the company, from being part of its board. Despite this, the decision to appoint Biró again was made unanimously by the workers, challenging the national government's determination to oust him last year.
In October of last year, Biró was expelled from the board of Aerolíneas Argentinas for supposedly promoting covert strikes and questioning the operational safety of the company. The union leader challenged his expulsion in court and demanded his reinstatement, although no decision has been made on this matter yet.
Workers argue that, according to the Companies Law, directors must be elected and removed by the shareholders, meaning the employees of the Employee Stock Ownership Plan (PPP) of Aerolíneas. The company is composed of 99% state shares and the remaining 1% by employees who are part of the PPP.
Despite Biró's election to the board member position in a shareholder meeting, company sources have stated that this appointment is not valid due to the lack of formality in the act performed by the PPP. The situation is still developing, and no definitive resolution has been reached on this matter.
