Proposal for Political Trial Against the President of Argentina

Various sectors of the opposition believe there are grounds to initiate a political trial in Congress and open a judicial case related to the situation caused by the promotion of a cryptocurrency company on social media by President Javier Milei. This has generated strong rejection and triggered considerable controversy, as the president has been accused of violating the Public Ethics Law.

Law 25.188 establishes the duties, prohibitions, and incompatibilities applicable to all persons exercising public functions, without exception. In particular, the opposition's criticism points to Article 2 of this regulation, passed in 1999, which details a series of precepts that public officials must comply with in the performance of their duties.

One of the most relevant points of this legislation refers to the obligation to act in accordance with ethical principles such as honesty, integrity, rectitude, good faith, and republican austerity. It also highlights the need to safeguard the interests of the State for the general welfare, prioritizing public interest over private. The law expressly prohibits receiving improper personal benefits related to public functions, as well as using privileged information for personal purposes.

Additionally, there is an obligation to justify decisions with transparency and protect State resources, avoiding their inappropriate use. Officials must also refrain from using state facilities and services for personal benefit or for third parties, as well as from intervening in situations where conflicts of interest exist. Regarding public procurement procedures, compliance with the principles of publicity, equality, competition, and reasonableness is required.

In short, the controversy surrounding President Javier Milei's conduct has sparked a debate about the compliance with the Public Ethics Law and has led to calls for legal actions from the opposition, based on alleged violations of the duties and prohibitions established for public officials.
