Judicial Protection for High Complexity Medications

The National Defender of the Rights of Children and Adolescents filed a judicial protection demanding the Government to provide medications for minors with complex diseases. This measure aims to ensure that the state responds within a certain timeframe to medication requests that had been interrupted.

Judicial Protection for High Complexity Medications

The National Defender of the Rights of Children and Adolescents filed a judicial injunction aimed at compelling the Government to provide the necessary medication for minors suffering from high-complexity diseases, including oncological treatments, which had been interrupted for months. 'We filed a judicial injunction demanding the delivery of high-complexity disease medications that the Government has stopped providing,' said Marisa Graham.

According to the Defender, the injunction submitted on January 2 at Federal Court No. 2 is a precautionary measure in favor of children and adolescents who require special high-cost medications. This action was promoted by the Civil Association Alianza Argentina de Pacientes (ALAPA) and Marisa Graham.

The Defender emphasized that the injunction 'obliges' the National State 'to resolve within 10 days the administrative files that have been pending for 60 days' and requires 'to address all ongoing files within 20 days.' In her statements to Splendid AM 990, Graham stressed that what they are demanding is simply compliance with the existing law. 'This is a violation of the rights of children and adolescents. All we are asking for is compliance with what the law dictates,' concluded the head of the agency.
