Argentina and US Conclude Reciprocal Trade and Investment Agreement

On Thursday, November 13, 2025, the White House issued a joint declaration in which U.S. President Donald J. Trump and Argentine President Javier Milei reaffirm the "strategic alliance" between the two nations and announce a "Framework for a Reciprocal Trade and Investment Agreement". The agreement is based on "shared democratic values and a common vision of free enterprise, private initiative, and open markets". The objective, according to the communiqué, is "to drive long-term growth, expand opportunities, and create a transparent, rules-based environment for trade and innovation".

The document details the central pillars of the new bilateral understanding:

Agricultural Market Access: Argentina opened its market to live cattle from the U.S. and committed to allowing market access for U.S. poultry within one year. The parties agreed not to restrict market access for products that use "certain cheese and meat terms". Registration processes for U.S. beef, pork, and dairy products will be streamlined.

Digital Trade: Argentina committed to facilitating digital trade by recognizing the U.S. as an "appropriate jurisdiction" for the cross-border transfer of data, including personal data. It will recognize as valid electronic signatures that are valid under U.S. law.

Tariffs: Argentina will grant preferential access to U.S. exports, including medicines, chemicals, machinery, technology products, medical devices, vehicles, and "a wide range of agricultural products". The U.S., in turn, "may consider favorably" this agreement when taking trade actions under Section 232 (National Security).

Elimination of Non-Tariff Barriers: Argentina commits to not requiring "consular formalities" for U.S. exports. The "statistical tax" on goods from the U.S. will be phased out. The dismantling of import licenses that restricted market access is ratified.

Standards and Norms: Argentina will allow the entry of U.S. goods that meet U.S. or international standards without requiring additional conformity assessment requirements. Importation of vehicles manufactured in the U.S. will be accepted under that country's federal safety and emission standards. Certificates from the U.S. Food and Drug Administration (FDA) will also be accepted.

Intellectual Property: Argentina will continue to improve enforcement against counterfeit and pirated products, including the online environment. It committed to addressing "structural challenges" cited in the U.S. Trade Representative's 2025 "Special 301" Report, including patentability criteria and delays in patent grants.

Strategic Alignment and Economic Security: Argentina "will improve cooperation with the United States to combat the non-commercial policies and practices of other countries". Both nations will identify tools to align approaches on export controls, investment security, and tax evasion. Cooperation will be facilitated to facilitate investment and trade in critical minerals.

State-Owned Enterprises and Subsidies: Argentina committed to addressing "possible distorting actions of state-owned enterprises" and industrial subsidies that may impact the trade relationship.

Labor and Environment: Argentina will adopt a ban on importing goods produced with forced labor and will strengthen enforcement of labor laws. Measures will be taken to combat illegal logging and the WTO agreement on fisheries subsidies will be implemented.

The communiqué concludes that both countries "will work rapidly to finalize the text of the Agreement for its signature" and will carry out their respective internal procedures before it enters into force.
