Rejection of the defense of former president Fernández

Prosecutor Ramiro González requested the judge to reject the recusal presented by the defense of former president Alberto Fernández in a gender violence case.

Rejection of the defense of former president Fernández

Federal prosecutor Ramiro González rejected the request to withdraw from the investigation into gender violence by former President Alberto Fernández against Fabiola Yáñez. Following the prosecutor's response, the judge must decide whether to accept or reject the former president's defense's request.

"On the contrary, the statements made seem to be mere subjective assessments from the recusing party, related to their dissatisfaction with what was timely ruled in the framework of these proceedings," González added. The Prosecutor's Office has fulfilled the duties imposed by the National Constitution and the Organic Law of the Public Prosecutor's Office, the prosecutor stated while asking the judge to reject the recusal request.

The arguments from the defense of the indicted former president "lack eloquence," the prosecutor expressed regarding the denial for the lawyer to attend Yáñez's testimonial statement last August, something that was in fact resolved by the judge, González clarified. He also denied various episodes mentioned in the recusal, such as alleged leaks to the press, undermining of the lawyer's work, among other aspects.

González denied having engaged in "lack of objectivity" in the proceedings initiated by the former first lady. He asked the case judge, Julián Ercolini, to reject Fernández's defense request to remove him from the case and warned that "the recusal suffers from serious foundational vices."

Ercolini must resolve a recusal request made by the former president's lawyer, Silvina Carreira, arguing that the prosecutor's office would have lost objectivity and "balance" in dealing with the parties. González denied all the lawyer's claims and assured that the case does not reveal "circumstances that objectively and reasonably allow for any presumption of a lack of objectivity on the part of this Prosecutor's Office."
