
The defense of the police officer involved in the murder of his neighbor in Lomas del Mirador during the Christmas celebrations opposed today the imposition of preventive detention. The prosecutor of the case, Diego Rulli, confirmed this decision to the news agency Noticias Argentinas, following the request made by Francisco Oneto, the defender of the former officer. The accused, Rafael Horacio Moreno, 74 years old, is being investigated for the death of Sergio David Díaz, 40 years old, which occurred almost a month ago.
The prosecutor had requested that the retired police officer remain in custody, accused of 'murder aggravated by the use of a firearm.' The judge in charge of the case, Agustín Gossn, now has five days to determine Moreno's procedural status.
The Prosecutor's Office presented arguments to support preventive detention, including the lack of consistency in the accused's statements, his history as a retired police officer, his reaction after the shot, and the distance he was from the victim when he fired. In a recent statement, Moreno claimed that he carried the weapon to intimidate and not to use it, and that the shot was accidental.
The prosecutor refuted this justification, pointing out that security videos clearly show how Moreno prepares the weapon before firing, indicating intent in his actions. Furthermore, based on the characteristics of the entry wound, it is believed that the distance from which the shot was fired was short.
In light of these elements, it was requested to maintain preventive detention and qualify the case as 'murder aggravated by the use of a firearm in real concurrence with the illegal possession of a war weapon.' The final decision rests with the judge in charge of the case.
