The Argentine government has approved a new voluntary retirement plan for personnel of the National Social Security Administration (ANSES), under a mutual agreement scheme. The measure was formalized through Resolution 68/2026, published this Monday in the Official Gazette, with the aim of continuing to reduce the public sector workforce, within the framework of the public spending modernization and efficiency policies being implemented by the Javier Milei administration. The initiative is called the Mutual Voluntary Retirement Plan (RVR), and it is based on Article 241 of the Labor Contract Law (No. 20,744), which means that the termination occurs by 'concurrent will' of both parties. The retirement must be formalized by a public deed or before a judicial or labor administrative authority, and subsequently must be presented to the Mandatory Labor Conciliation Service (SECLO) for its ratification and homologation. The regulation stipulated that the retirement regime will apply to personnel of the social security agency with at least two years of seniority, and it was established that adherence 'constitutes an act strictly voluntary of the agent, and its granting is subject to the exclusive evaluation and approval of ANSES, without generating any subjective right to its concession'. Among the parameters and conditions that will govern access to retirement, it was determined that those excluded are those who are being prosecuted or convicted for crimes against the public administration, those involved in disciplinary proceedings, those who have initiated retirement proceedings or have submitted their resignation, those over 62 years of age, and those with pending labor disputes, unless they expressly waive them. The adherence period will extend until April 5, 2026, inclusive, while for those on annual leave or maternity leave, the signing of the agreement may be deferred until its completion. At the same time, the regime establishes that employees with active union mandates must resign from their position and union representation to apply, and must provide clear evidence before the Directorate of Union Relations.
