ARCA Introduces Incentives for Rental Contract Registration

The Revenue and Customs Control Agency (ARCA) announced a series of incentives aimed at homeowners to promote the registration of rental contracts. Resolution 5546/2024, published in the Official Bulletin, establishes benefits for sole proprietors who rent properties and decide to formalize their contracts.

According to the new measure, those sole proprietors who register their rentals in the Simplified Regime can enjoy advantages such as the complete elimination of the fixed fee for the sole proprietorship, exemption from the tax on banking transactions, and the possibility to deduct 10% in the Income Tax per year.

To access these benefits, homeowners must meet certain requirements, such as registering the rental contracts in the Real Estate Rental Registry (RELI) within a maximum period of 15 days after signing the contract, being registered as sole proprietors in the rental activity, not owning more than three properties, and not exceeding the income limit established for category K of the sole proprietorship.

Regarding the most commonly used contract modality by real estate agencies and tenants during the past year and so far this year, a 24-month contract in pesos has been highlighted, with quarterly adjustments based on the Consumer Price Index (CPI) or the Rental Contract Index (ICL).
