Argentina Prepares to Privatize State-Owned Companies

The government of Javier Milei initiates a process to privatize several companies that were state-owned, allowing their conversion to joint-stock companies. The deregulation decree aims to accelerate this process.


Argentina Prepares to Privatize State-Owned Companies

The Government plans to resolve the issue of privatizing or completely granting other companies by March. To achieve this, it must present a bill to Congress for approval. In this regard, the process would apply to companies that are currently State-Owned Enterprises, which prevents their sale or transfer to private hands, limiting their ownership only to the National State.

The Government incorporated an article in DNU 70/23 that establishes the transformation of these companies into Public Limited Companies, as part of the extensive package of economic deregulations promoted by Milei at the beginning of his term. This would allow the State to sell shares or grant services to private entities, following the corresponding administrative procedures. The process is managed by Diego Chaher, head of the Agency for the Transformation of Public Enterprises (ATEP).

The 13 state-owned companies that are in this process include FASE, SOFSE, ADIF, Casa de la Moneda, among others. These companies have been transformed into Unipersonal Public Limited Companies (SAU) with the ultimate goal of their dissolution. For example, in the case of Ferrocarriles Argentinos (FASE), the Government seeks to transfer its services to the private sector through the sale or concession of the companies.

The process initiated by the Government aims to privatize these public companies and regularize their structure to facilitate their sale or concession in the future. Companies like Corredores Viales have already begun their privatization process. In the case of AGP, it was dissolved and replaced by an agency with similar functions. This process is part of the Government's liberal-libertarian vision to reduce state intervention in businesses. The goal is to privatize several public companies before the end of Milei's term.
