
In March of this year in Neuquén, a tragic incident occurred in which a father forgot his son inside the car for hours. This event resulted in the child's death days later in the hospital. The 3-year-old boy, named Genaro, was admitted to San Lucas clinic with severe neurological damage caused by suffocation from confinement in the car. The tragedy happened when the father was supposed to take the little one to kindergarten, but he headed to his work and forgot the child in the vehicle.
According to the investigation, the child remained six hours inside the parked car on the street until his mother found him unconscious and with marks on his body from trying to free himself from the seat. After the inquiries made, it was determined that there was no intent on the part of the parents, but rather an act of negligence.
The Public Prosecutor's Office of the province recently confirmed that the father was subjected to natural punishment. This was based on article 106 paragraph 3 of the Neuquén Criminal Procedure Code, which establishes that in cases where the defendant suffers serious harm as a consequence of the act, the imposition of a penalty may be considered unnecessary and disproportionate. The prosecutor of the case emphasized that, although the father was responsible for the death of his son, there was no intention to cause harm.
The autopsy of the minor determined that the cause of his death was suffocation due to confinement, with no injuries suggesting physical abuse. The report concluded that the incident was due to the negligence of the father, according to testimonies from witnesses and people close to the family.
