An Argentine court denied house arrest to a man serving 19 years for rape, rejecting his lawyer's argument about childcare and citing the risk of reoffending at the proposed home.

Court Denies House Arrest Request for Julieta Prandi's Ex-Husband

The Criminal Court No. 2 in Campana has denied house arrest to Claudio Contardi, the ex-husband of Julieta Prandi, who was sentenced to 19 years in prison for aggravated sexual assault in a context of gender-based violence. His request was made by his defense lawyer. The ruling, which was made available to the Argentine News agency, states that the denial is due to the risk of flight, the severity of the crime, and because the proposed address is where the abuse occurred. Fernando Ezequiel Sicilia, Contardi's current lawyer, had requested the court to grant his client house arrest or the benefit of attending his home four times a week to care for his four-month-old daughter. Sicilia emphasized that the sentence handed down by the court “has not yet been finalized and has not even obtained, at a minimum, a double conformity”, as well as that his family is going through a serious situation due to his roots in the area and that there is no risk of flight. They proposed the residence located in the private neighborhood of Septiembre, on Route 9 at kilometer 47, the same place where the sexual abuse occurred. In the document, the court explained that the first report “already warned that this scenario constitutes a possible risk environment in the coexistence dynamics, capable of reinstating previous dynamics of power, control or violence”, which is why it was not the best space for Contardi to live there. Finally, the document states that “the conditions that justify Contardi's imprisonment have not disappeared”, which led to the conclusion that, for the time being, “it is convenient for him to remain subject to the precautionary measure currently in force against him, in order to ensure the purposes of the process”. Prandi's ex-husband was sentenced to 19 years in prison in August of this year and is currently being held in Unit No. 41 of Campana Prison.
