The project is promoted by Senator Carlos Linares, representing Chubut for the Justicialist Party, in collaboration with a group of feminist lawyers from the AMBA (Greater Buenos Aires). It aims to introduce modifications to the regime of parental responsibility, with a focus on protecting the rights of children in cases of non-compliance by one of the parents. The project establishes the creation of a legal figure of “suspension of parental responsibility,” which would allow judges to temporarily interrupt the legal rights of a parent in certain cases. The measure would apply in cases of non-payment of child support or a prolonged absence from the child's life, set at more than three months. “This proposal allows judges to temporarily interrupt the legal rights of a parent if they fail to comply with the child support payment or are absent from the child's life for more than three months,” explained the legislator. It also seeks to modify the current logic of parental authority, preventing it from being used as a blocking tool in conflict contexts. “We seek to prioritize the best interest of the child over negligent or abusive behaviors and prevent the non-compliant parent from blocking decisions concerning the children and girls,” states the deputy. The proposal takes as a reference the public situation of the artist Cazzu, whose real name is Julieta Cazzuchelli, who exposed legal conflicts with musician Christian Nodal, the father of her daughter. In Mexico, the initiative was presented weeks ago by Deputy Sandra Arreola Ruiz, a member of the Green Ecologist Party, on International Women's Day. In that country, the project also contemplates agile mechanisms for the responsible parent to authorize transfers and decisions without depending on the one who does not comply with their parental duties.
