Former senator Edgardo Kueider, detained under house arrest in Paraguay, has filed a motion in Chamber V of the Federal Administrative Court to prevent the assumption of his replacement, Estefanía Cora. Kueider argues that his removal was illegal and contends that his seat cannot be occupied by another legislator until the Justice system issues a definitive ruling on his situation.

In his legal submission, Kueider warns that his removal could set a dangerous precedent that would allow for the expulsion of any senator by decision of the majority of the body. For his part, Zimmermann, who had left his seat occupied by Kueider, explained that he agreed with the governor on his return to the Senate to maintain representation for Chaco before the Federal Government.

Kueider argues that the appointment of two senators for the same seat would create institutional and economic conflicts, as it would involve paying two salaries and maintaining two teams of advisors. The future of the seat that Kueider occupied will be decided soon, while the Senate continues with its legislative agenda and the Justice evaluates his claim.

In his statement, Kueider emphasizes that his seat cannot be occupied until his appeal is resolved, asserting that allowing Cora to take the oath would be an unconstitutional act. He warns of the risk of legitimizing the arbitrary expulsion of senators and criticizes the intervention of the Executive Power in a function exclusive to the Legislative.

The former senator highlights the institutional, electoral, economic, and legal implications of allowing the assumption of a replacement before his legal situation is resolved.
