The federal justice system took over the case after the provincial justice system declared itself incompetent and consolidated the cases. The investigation, based on reports from the National Institute of Associativism and Social Economy and AFIP's database, concluded that over 33 fiscal periods, SanCor acted as a withholding agent without fulfilling the obligation to deposit the withheld funds. Despite both defendants refusing to testify when questioned, they did not deny the facts attributed to them. Buenos Aires, December 2 (NA) – The federal prosecutor's office in Rafaela requested the prosecution of two former presidents of SanCor Cooperativas Unidas Limitadas for the misappropriation of social security resources amounting to over $1.644 billion. The request applies to José Pablo Gastaldi and Alberto Eduardo Sánchez, who were at the helm of the company's Board of Administration between February 2020 and January 2024, a period during which, according to the accusation, worker contributions were withheld but not deposited into the social security, pension, and social welfare systems as established by law. According to the opinion accessed by the Argentine News Agency, Gastaldi allegedly committed 17 offenses between 2020 and 2022, while Sánchez is accused of another 16 corresponding to the years 2022, 2023, and January 2024, all of them in real contest and as the author. The file was initiated following criminal complaints by workers from the Sunchales and Don Torcuato plants, who detected that the company had not transferred the withheld contributions. Therefore, the prosecutor's office requested that the judge order their prosecution under Article 306 of the National Criminal Procedure Code. As for coercive measures, the prosecutor's office considered the obligation to report changes of address to be sufficient, given that the accused have no criminal records, have a fixed address, declared work activity, and appeared for judicial summons.
