In the middle of the party, Moreno approached and menacingly demanded that they turn down the music, to which he received a negative response. Faced with this situation, Moreno drew his weapon, displayed it, and began to intimidate the victim, who became enraged: "You're a cool guy. Don't you pull iron on me. Who do you think you are?". The Oral Criminal Court (TOC) No. 2 of La Matanza, made up of Judge Lucila Pacheco, ruled the disqualification for a period of 10 years for the possession of firearms, while dismissing the request of the culprit's lawyers for him to be granted house arrest. Prosecutor Sergio Antín had requested that Moreno be sentenced for "homicide aggravated by the use of a firearm." Díaz was with his friends and family on the sidewalk of his house listening to music and drinking alcohol.
