Judge Jorge Criado has decided to impose house arrest on Victoria Núñez Fernández, after reviewing the evidence against her and considering it to be vague or null. The magistrate made this decision upon finding new elements that favor the defendant and concluded that the evidence presented by the defense should be taken into account for the ongoing investigation.
During the resolution, the judge carefully analyzed the arguments from both parties and decided to apply the measure of house arrest instead of granting immediate freedom to Victoria. Although new elements in favor of the defendant were acknowledged, the precautionary measure was maintained due to possible risks of flight and obstruction of the process as expressed by the investigators.
The Prosecutor's Office has announced that it will conduct examinations on Victoria's vehicle to verify the validity of the satellite data presented as evidence. For its part, the defense of the accused has presented new arguments supported by technical evidence that place the defendant's vehicle in a location distant from the site of the fire in question.
The prosecutors from the Prosecutor’s Office committed to verifying all the information provided by Victoria's public defender, Valeria Ponce. The Public Prosecutor's Office of the province of Chubut highlights that the evidence presented by the prosecutor's office was considered null or vague, and a review of the decision made regarding the case is expected.
In the context of the investigations into the wildfires in Patagonia, it has been reported that the judiciary of Chubut continues to harass and intimidate the Mapuche Tehuelche communities. Victoria was detained in the Lof Pillán Mahuiza and is accused of alleged participation in a fire at Estancia Amancay.
During the detention control hearing, 60 days of preventive detention were dictated for Victoria, which she will serve under house arrest at a residence in Corcovado. The defendant's defense has presented arguments supported by technical evidence to challenge her involvement in the investigated fire.
