Victoria Dolores Nuñez Fernández, 33 years old, was arrested on February 11 in the Lof Pilliñ Mahuiza, recovered Mapuche territory, where she has lived for five years. Both the prosecutor's office and the judge indicated that there is a possibility that Victoria participated in a fire at Estancia Amancay on January 18. The prosecutor's office argued that Victoria could hinder the investigation, which led to the request for preventive detention.
The prosecutor's office presented as evidence the alleged participation of Victoria in the fire, but this evidence was considered weak or unclear. It is mentioned that the peaceful way of life of the Mapuche communities is seen as a threat to capitalism, according to the authorities.
During the raid in Lof Pillán Mahuiza, a pamphlet was found that was used to disseminate the story of a community member. The authorities alleged that Victoria has ties to other Mapuche groups, such as the recently evicted Lof Pailako. The defense proposed that Victoria could live in the city during the investigation, but the prosecutor's office insisted on preventive detention.
The judge ordered 60 days of preventive detention for Victoria, arguing the danger of flight and hindrance to the investigation. Raids were recorded in several Lof in the province of Chubut, resulting in Victoria's detention and her temporary isolation at the Esquel Police Station.
The accusation is based on the "probability of participation" of Victoria in the fire at Estancia Amancay. It was highlighted that the Estancia lacks security cameras that could confirm her connection to the incident. The Mapuche community mobilized to support Victoria during the control hearing in Esquel held on February 12.
