Buenos Aires, March 17 (NA) – A National Labor Court suspended this Tuesday the effects of the agreement that provided for the transfer of Labor Justice from the national jurisdiction to the city of Buenos Aires, in response to a precautionary measure promoted by the CGT Union of Judiciary Employees of the Nation (UEJN). The decision was made by the National Court of First Instance in Labor Matters No. 30, under Judge Herman Mendel, in a case initiated by the guild led by Julio Piumato, and the CGT considered it to be “an important step in defense of the judicial system and the rights of workers.” The measure will be in effect until a final judgment is issued on the merits of the case. In the ruling, the magistrate also ordered the National State to submit a report within three days, as part of the trial process. The ruling ordered the suspension of all effects of the transfer agreement of the judicial function in labor matters, signed between the National State and the Buenos Aires City Government, and incorporated as Annex I of Law 27.802 on Labor Modernization. According to the ruling, the magistrate found, at this initial stage of the process, the requirements of verisimilitude of the right and danger of delay, necessary to issue the precautionary measure. The union had requested the declaration of unconstitutionality of several articles of the law, the regulatory decree and the transfer agreement, arguing that they affect labor rights, the stability of workers and the structure of labor justice. Among other points, the UEJN warned about the lack of guarantees regarding the transfer of personnel, possible changes in working conditions and the impact on more than 1,500 judicial agents. The judge also pointed out possible irregularities in the transfer procedure, considering that it would not have complied with the mechanisms provided for in Law 24.588, such as the intervention of the Bicameral Commission. It was also indicated that there are recent precedents in the Federal Administrative Litigation Chamber that endorse similar claims regarding the implementation of local judicial bodies in labor matters. Union Celebration For its part, the CGT highlighted that the ruling “exposes the institutional seriousness of the measures promoted, which were advancing on this jurisdiction without respecting the constitutional procedures and the guarantees that ensure judicial independence and the effective protection of labor rights.” “From the CGT we maintain that this area of Justice is key to balancing the inequalities between capital and labor.”
