Thus, the highest court resolved a jurisdictional conflict between the Federal Criminal and Correctional Court No. 5, led by Judge María Eugenia Capuchetti, and the Criminal, Contraventions, and Misdemeanors Court No. 4 of the City of Buenos Aires. The case began with the complaint filed by Rodolfo R. Hernani Barilli, host of the Telefé Noticias newscast, who recounted that he, his wife, and his son began to receive threatening messages from an Instagram user demanding that they publish information about alleged criminal acts. According to the ruling of the Ministry of Public Prosecution, the demands also extended to his relatives and included death threats, torture warnings, and other consequences, which generated fear and intimidation for the journalist. The federal court had considered it to be 'simple threats' with a particular motivation and declined jurisdiction in favor of the City's justice system.
