In his vote, Yacobucci pointed out that no risky situation for the integrity or rights of the daughters emerged, nor any other circumstance that would justify modifying the detention. The social and psychological reports incorporated into the case indicated that the girls remain under the exclusive care of their mother and her partner, in a family environment that guarantees their educational, recreational, and affective needs.
