Buenos Aires, February 10 (NA) – Federal Judge Sebastián Casanello processed the company of broker Héctor Martínez Sosa, a friend of former President Alberto Fernández, within the framework of the case investigating alleged incompatible public function negotiations linked to the state insurance system.
The resolution emphasized that the companies did not implement control mechanisms or integrity programs, and tolerated illicit conduct that would have caused harm to the public treasury. The resolution included embargoes on assets and money and affected other companies in the sector.
In the same ruling, to which the Argentine News Agency had access, the magistrate also processed the former general administrator of the Olivos Presidential Residence, Hugo Rodríguez, accused of facilitating meetings between the broker and then-President Fernández without registering them and with knowledge of the investigated plan.
According to the resolution, Rodríguez acted as a nexus between the businessman and the former head of state, allowing access to Quinta de Olivos without leaving a record, including a meeting on August 7, 2020, which was documented in a photograph considered evidence of the personal link between them.
The judge also described episodes that occurred between February and March 2022, when Rodríguez would have coordinated a meeting between Martínez Sosa and Fernández to influence the continuity of then Nación Seguros director Gustavo García Argibay.
Casanello maintained that the former Olivos administrator “knew of the conflict of interest and collaborated in its exploitation,” for which he was processed for incompatible public function negotiations and breach of the duties of a public official, with a seizure of 787,997,801.56 pesos.
Regarding the companies, the ruling advanced on the criminal liability of legal persons for a maneuver aimed at improperly benefiting producers and insurance companies, in the context of decree 823/2021, which forced the public sector to contract insurance exclusively with Nación Seguros S.A.
Among the firms named, Héctor Martínez Sosa y Cía. S.A. was identified as the beneficiary of commissions of over 416 million pesos, while other companies such as Bachellier S.A., San Germán Seguros S.A., and San Cristóbal Sociedad Mutual de Seguros Generales were also processed.
The case has the intervention of Federal Prosecutor Carlos Rívolo.
