The Argentine Executive Branch has authorized, through a decree, the Chief of Cabinet, Manuel Adorni, to sign a “transfer agreement” for the handover of the National Labor Justice of the Federal Capital to the Autonomous City of Buenos Aires. Through decree 95/2026, published in the Official Gazette, President Javier Milei delegated to Adorni the authority to sign an agreement with the Buenos Aires City government for the labor jurisdiction to pass to the city's orbit. “The power to sign, on behalf of the National State, a transfer agreement of powers related to the judicial function in labor matters, from the national scope to the Autonomous City of Buenos Aires, is delegated to the Chief of Cabinet of Ministers,” the decree states. According to what the Argentine News Agency was able to learn, the delegation provided for “covers the signing of addenda, modifications or complementary agreements.” The measure is justified, according to the decree's considerations, because at the time the National Labor Justice was regulated, the capital district “did not have the status of an Autonomous City,” which is the case today. It also cites as a precedent that after the 1994 Constitutional Convention, Law 24.588 was enacted in 1995, “whose article 6° authorizes the National State and the Autonomous City of Buenos Aires to sign agreements whose object is the transfer of bodies, functions, powers and assets.” It adds that the Supreme Court of Justice stated in a previous ruling that “the national character of the ordinary courts seated in the Autonomous City of Buenos Aires is merely transitory” and requested “to adopt the necessary measures to guarantee the full exercise by said City of its own jurisdictional powers.” It is expected that Labor Justice will play a prominent role in case labor reform is approved in Congress, as requests for injunctions and precautionary measures from unions and other entities are anticipated, which will have to be analyzed in this jurisdiction.
