The Public Prosecutor's Office has formally requested the case investigating the death of Emmily Rodrigues Santos Gomes, a 26-year-old Brazilian woman who died after falling from the sixth floor of a building in the Retiro neighborhood in March 2023, be elevated to trial.
The Federal Prosecutor's Office No. 10, under the interim management of Alberto Gentilli, together with the Specialized Federal Unit for Violence Against Women (UFEM), led by Mariela Labozzetta, believes that businessman Francisco Sáenz Valiente must answer before a tribunal for the crimes of free supply of narcotics, facilitating the place for its consumption, and aggravated abandonment of person resulting in death.
Although the National Appeals Court had previously processed the accused for manslaughter, the prosecutors argue that the figure of aggravated abandonment of person fits more precisely with what happened during the early hours of March 30th in the apartment on Libertad Street.
The Argentine businessman Francisco Sáenz Valiente is being investigated for the death of a young Brazilian woman.
«It is opportune to recall that the instruction stage is purely preparatory and that the legal qualification of the investigated conduct may undergo certain modifications until the time of the accusation,» Labozzetta and Gentili justified the change in legal approach.
The facts reconstructed in the file, to which the Argentine News Agency had access, indicate that Rodrigues Santos Gomes arrived at Sáenz Valiente's home after 3 a.m., where she participated in a meeting that included the consumption of alcohol and drugs such as cocaine and "tuci".
According to the account of the businessman himself in his statements, the young woman suffered a severe episode of alteration: "Mili seemed possessed, she had a strange look and at some point something happened to her. She said nonsense in Portuguese, then started shouting religious things, very strong screams, insulting, even shouted 'police'."
