Buenos Aires, December 24 (NA) – The lawyer of psychiatrist Agustina Cosachov, one of the eight accused in the death of Diego Armando Maradona, warned that he will “go all the way to the very end” to prevent his client from being tried twice. Vadim Mischanchuk spoke with the Argentine News Agency and criticized the ruling of the San Isidro Chamber of Guarantees and Appeals, which rejected the motions filed by the defense teams. “We are appealing this decision because subjecting the accused to a new trial violates the guarantee that prohibits a person from facing a criminal process twice for the same facts,” questioned the lawyer. In this sense, he emphasized that the previous public oral trial was declared null and void due to a documentary by former judge Julieta Makintachy, not due to the responsibility of the accused: “It was canceled due to deficiencies of the State itself.” On March 17, 2026, a new trial for the alleged intentional homicide with eventual intent of the Argentine star will begin, but Mischanchuk considered that this process “only serves to clean up the image of the judicial system and to look good with public opinion at the expense of the rights of the accused.” “The second reason for our protest has to do with the possibility of advancing a new trial that is held through two different hearings that could lead to contradictory sentences and future absolute nullities,” he remarked. The lawyer had filed a non bis in idem (already judged) recourse to prevent the psychiatrist from going through the second trial. However, according to the 11-page document accessed by NA, the motion, like those filed by the defense teams of neurosurgeon Leopoldo Luque; nurse Ricardo Almirón and Swiss Medical coordinator Nancy Edith Forlini, was declared inadmissible. For Mischanchuk, both decisions affect Cosachov, so he is considering exhausting all instances that “the law grants” and making it impossible for “all parties to be at risk of accessing objective truth”: “We are going to go all the way and to the last consequences.” “With the new medical examinations, it has been completely ruled out that the professionals intentionally caused the death of Diego,” it was stated.
