Buenos Aires, Dec 4 (NA) - The Federal Chamber of Buenos Aires revoked this Thursday by majority a ruling by Judge Sebastián Casanello and ordered to deepen the expert reports on the origin and authenticity of the audios that initiated a case for alleged corruption in the National Disability Agency (ANDIS). In the ruling, signed by judges Martín Irurzun and Roberto Boico, and by Judge Eduardo Farah in dissent, and to which the Argentine News Agency had access, it was pointed out that the circumstances under which the recordings attributed to the former head of the agency, Diego Spagnuolo, have not yet been proven. The defenses of Spagnuolo and the brothers Jonathan, Emmanuel, and Eduardo Kovaliker had requested the nullity of the audios and all the proceedings carried out, arguing that it was material of uncertain origin, potentially altered, and disseminated without consent. They also denounced a violation of the right to privacy and the absence of expert reports that endorse their authenticity. The Chamber considered that Casanello's decision to reject that claim was based on unverified premises. Irurzun and Boico pointed out that the investigation was activated based on journalistic publications that reproduce information from the same questioned audios and that it has not yet been clarified whether they were edited, manipulated, or generated using artificial intelligence. In dissent, Judge Farah defended the original resolution and affirmed that the content of the audios provides verifiable data on alleged irregular maneuvers in the ANDIS, which, in his opinion, gives sufficient verisimilitude to justify the investigation. The Chamber ordered to return the file to the court of origin to carry out the pertinent expert reports before issuing a new resolution.
