The Supreme Court has upheld the final verdict against the police officer for attempted aggravated homicide, committed by abusing his function and by the use of a firearm. As the judges pointed out, Ayala tried to kill Cabello on November 9, 2015, around 3:45 PM at the door of his house, located at Martín Rodríguez 500 in the La Boca neighborhood of Buenos Aires. The officer shot Cabello in the neck, groin, and leg, and then went to the next-door house. The young man recounted that he had gone out to buy food and noticed that the police officer was looking at him defiantly. Police officer Ricardo Gabriel Ayala was arrested after being sentenced last week to 16 years in prison for the shooting he committed against Lucas Cabello in November 2015 in the La Boca neighborhood of Buenos Aires. The measure had been requested by the Public Prosecutor's Office before the Oral Courts in Criminal and Correctional Matters No. 1, and then-member of the Metropolitan Police was arrested after the Supreme Court of Justice rejected an extraordinary appeal from his defense last week and confirmed his 16-year sentence. The highest judicial body considered that Ayala's lawyer had not met the technical requirements of the appeal, so they dismissed his filing. One of the injuries damaged his bone marrow and caused irreversible consequences. On December 5, 2019, the Criminal Oral Court No. 1 convicted Ayala of 'attempted aggravated homicide for having been committed by abusing the police function and by the use of a firearm,' in addition to imposing a ten-year disqualification for carrying weapons or performing security functions. After an exchange of words, Ayala pointed his regulation weapon at him and fired three shots, which hit the neck, groin, and leg. Division II of the National Court of Criminal Cassation confirmed the sentence by rejecting the defense's hypothesis of a supposed 'excess in legitimate defense'.
