Argentine Agribusiness Welcomes Labor Reform

Grain and oilseed companies in Argentina celebrated the approval of the Labor Modernization bill in the Senate, highlighting that if enacted into law, it will 'end fifty years of legislative anarchy and establish the regulatory incentives necessary for the generation of dignified and formal work, without violating legitimate rights.'

'We believe the importance of the proposed modernization lies in the redefinition of certain regulations, making them clearer, more precise, and fundamentally more predictable, which will prevent their violation through discretionary interpretation and will make registered employment a reasonable alternative,' the agro-industrial entities said, according to the Argentine News Agency.

Specifically, they highlighted that, among other things, the bill 'breaks with the current scheme of overprotection for those in formal work through a distorting jurisprudential interpretation of the underlying law, which has traditionally scared off the hiring of new workers within the legal system. This ultimately made the cost of any termination unpredictable, leading to the discontinuation of formal hiring to avoid that risk.'

'This Project does not eliminate compensation, but transforms it into an anticipatable and, eventually, financeable variable,' they stated.

They also mentioned that 'equal mention is deserved for the analogous exclusion of collective labor conventions, the voluntary bipartite agreement on the compensation for extraordinary working hours; the guaranteed limited provision of labor in the provision of essential services; adaptation of the ultra-activity of collective conventions; the restitution of the balance in unfair practices by any of the parties in a conventional discussion; and the adaptation of the procedure for union affiliation and its consequences during its development, among many other innovations.'
