Trial begins against school counselor for false rape accusation

In Bahía Blanca, the oral and public trial against Fiorella Damiani, a Bahía Blanca school counselor from the libertarian party, accused of falsely reporting two men for a rape in 2017, begins today at the Criminal Oral Court No. 1 of that city. According to what the Argentine News Agency learned, Damiani is accused of aggravated false testimony for violating article 275 of the Penal Code, which states that if committed in a criminal case, to the detriment of the accused, the penalty will be from one to ten years in prison. The trial will have three hearings and is expected to conclude this Thursday, February 26. The woman was detained on April 10, 2025, at España 1147 street, in Bahía Blanca, after the Justice determined that the accusation she had made against two men was false. In 2017, the counselor, belonging to Javier Milei's political party, had denounced Joaquín Álvarez and Fernando Pereyra, who were detained accused of the crime of aggravated sexual abuse with carnal access aggravated by being committed by two people. However, videos demonstrated that it was a consensual encounter by all parties during a sex party. The presentation of those files allowed both to regain their freedom. After being acquitted, Álvarez and Pereyra filed lawsuits in civil and criminal court, and following the progress of the investigation, Damiani's detention was carried out.
